The Ukrainian High Anti-Corruption Court adopted a new decision in the Rotterdam+ case

The Appeal Chamber of the High Anti-Corruption Court of Ukraine (HACC) decided to cancel the closure of the "Rotterdam+" case. In addition, it is emphasized that a new trial was scheduled for her in the first instance.

The Rotterdam+ case could not be “buried”

As mentioned earlier, the HACC first instance dismissed this case due to the expiration of the pre-trial investigation period.

However, prosecutors disagreed with this decision and decided to appeal it.

The HACC Appeals Chamber issued a new verdict regarding the "Rotterdam+" case. The judges overturned the court's decision to close the first episode and cancel the seizure of the accused's property. The case was returned to the first instance for reconsideration.

It is worth paying attention to the fact that the judges of the HACC Appeal Chamber, Dmytro Mykhaylenko, Mykola Glotov and Oleksandr Semennykov, made the decision.

In addition, it is emphasized that the High Anti-Corruption Court's first instance decided to close the case.

The reason was allegedly the end of the pre-trial investigation period. One of the judges, Viktor Nogachevskyy, then spoke against the closure.

What is essential to know about Rotterdam+

Back in January 2023, the National Anti-Corruption Bearue of Ukraine (NABU) and Special Anti-Corruption Prosecutor’s Office (SACPO) officially announced the completion of the investigation into the suspicion of 15 people involved in the introduction and operation of the so-called "Rotterdam+" formula, due to which electricity consumers illegally overpaid more than UAH 20 billion during 2018-2019.

Half a year ago, NABU and SACPO sent the first episode of the "Rotterdam+" case to court, accusing six people of causing losses to more than UAH 19 billion electricity consumers during 2016-2017.

It is worth noting that on October 3, the High Anti-Corruption Court partially satisfied the SACPO request and seized the property of three defendants in the "Rotterdam+" case.
