A disciplinary case by Ukraine's High Council of Justice (HCJ) against the judge was opened on January 10, 2024, based on the fact that he was accused of committing a fatal road accident.

On January 31, the HCJ Second Disciplinary Chamber stopped the proceedings against Judge Oleksiy Tandyr, who is accused of a traffic accident at a roadblock that led to the death of a National Guardsman. The broadcast of the meeting evidences this.
According to Vitaly Salikhov, a member of the HCJ, he proposed to stop the consideration of the disciplinary complaint because he does not have time to draw up a conclusion on the case. In particular, he requested information from the prosecutor's office but did not receive it for long. In addition, he said that he is going on vacation next week.
The law provides that there are 30 days to make a verdict. Since the complaint was opened on January 10, the conclusion must be submitted for consideration by February 10.
At the same time, on the morning of January 31, he received documents from the prosecutor's office and a statement from Tandyr regarding his desire to participate in considering the complaint. However, the Council of Justice member said that he still cannot conclude because the content of the received materials is unknown to him.
An HCJ member stated that suspending the proceedings would help "make all the conditions to deal with the disciplinary complaint objectively, and not to remove from responsibility" Judge Tandir.
Three out of five chamber members supported the indefinite suspension of the disciplinary case. The decision was made for the period necessary to obtain the requested information.
